Resolve, To Establish a Moratorium on the Transportation of Tar Sands
Sec. 1. Two-year moratorium on the transportation of petroleum products derived from bituminous sands established. Resolved: That a 2-year moratorium from the effective date of this resolve is established on the transportation in the State of petroleum products derived from bituminous sands, including transportation by road, rail, water and pipeline; and be it further
Sec. 2. Department of Environmental Protection to study effects of transportation of petroleum products derived from bituminous sands. Resolved: That the Department of Environmental Protection shall study the potential effects on the State of the transportation of petroleum products derived from bituminous sands, including the effects on the health and safety of the public and the environment and the potential costs of remediation of an oil spill. The study must be conducted within the existing resources of the Department of Environmental Protection; and be it further
Sec. 3. Report. Resolved: That, no later than January 31, 2014, the Department of Environmental Protection shall report the results of the study under section 2 and any suggested legislation to the Joint Standing Committee on Environment and Natural Resources. The Joint Standing Committee on Environment and Natural Resources may submit a bill based upon the study to the Second Regular Session of the 126th Legislature.
SUMMARY
This resolve establishes a 2-year moratorium on the transportation of petroleum products derived from bituminous sands, also known as tar sands, and directs the Department of Environmental Protection to study the potential effects on the State of the transportation of petroleum products derived from bituminous sands, including the effects on the health and safety of the public and the environment and the potential cost of remediation of an oil spill.
