Amend the bill by striking out everything after the enacting clause and inserting the following:

Sec. 1. State employee health plan reimbursement to members; calculation and transfer of funds. Notwithstanding the Maine Revised Statutes, Title 5, section 285 or any other provision of law, not later than December 31, 2013, the Executive Director of Health Insurance shall calculate the amounts of and reimburse those members enrolled in the group health plan established pursuant to Title 5, section 285 for the applicable differences in copayments and deductibles paid by those members for health services received at one or more of 6 hospitals not included on the State Employee Health Commission's list of preferred hospitals from July 1, 2012, when the initial list was published, to October 1, 2012, when those hospitals were added to the list.

Sec. 2. Appropriations and allocations. The following appropriations and allocations are made.

Initiative: Provides funding for the one-time costs of reimbursing state employee health plan members for the difference in copayments and deductibles paid by those members for services provided at hospitals not on the preferred provider list from July 1, 2012 to October 1, 2012.

This amendment is the minority report of the committee and replaces the bill, which is a concept draft pursuant to Joint Rule 208. The amendment requires the Executive Director of Health Insurance to calculate the amounts of and reimburse those members enrolled in the state employee health plan for the applicable differences in copayments and deductibles for services received at one or more of 6 hospitals not included on the State Employee Health Commission's list of preferred hospitals from July 1, 2012, when the initial list was published, to October 1, 2012, when those hospitals were added to the list. The amendment also provides funds for the reimbursement in an appropriations and allocations section.
