An Act Regarding Municipal General Assistance

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 22 MRSA §4301, sub-§3,  as enacted by PL 1983, c. 577, §1, is amended to read:

3. Eligible person.   "Eligible person" means a person who is qualified to receive general assistance from a municipality according to standards of eligibility determined by the municipal officers whether or not that person has applied for general assistance . , but does not include:
A A person who is ineligible to receive benefits under the Temporary Assistance for Needy Families program pursuant to section 3762, subsection 18; or
B A person who has had benefits fully terminated under section 3763, subsection 1.

Sec. 2. 22 MRSA §4309, sub-§1,  as amended by PL 1989, c. 840, §4, is further amended to read:

1. Eligibility of applicant; duration of eligibility.   The overseer shall determine eligibility each time a person applies or reapplies for general assistance pursuant to this chapter and the ordinance adopted by the municipality in accordance with section 4305. The period of eligibility must may not exceed one month. At the expiration of that period the person may reapply for assistance and the person's eligibility may be redetermined. A person is not eligible for general assistance if that person is no longer eligible to receive benefits under the Temporary Assistance for Needy Families pursuant to section 3762, subsection 18 or has had benefits fully terminated pursuant to section 3763.

This bill makes individuals who have reached the 60-month lifetime limit for benefits under the Temporary Assistance for Needy Families program or who have had benefits fully terminated for noncompliance with the requirements of the program ineligible for municipal general assistance.
