An Act To Protect Maine Consumers

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §207, sub-§3  is enacted to read:

3 Governing law of contract.   A contract that provides for goods or services to be provided primarily in the State and to which a resident individual or business is a party may not require the resident individual or business to:
A Submit to the jurisdiction of another state or to any foreign jurisdiction;
B Litigate in a foreign jurisdiction any dispute arising from the contract or from the services or goods that are subject to the contract;
C Agree that a law other than the law of this State applies to any dispute under the contract; or
D Waive the right to a jury trial.

Any provision in a contract in violation of this subsection is void.

summary

This bill provides that it is an unfair trade practice for a contract for goods or services provided primarily to a resident individual or business to require disputes regarding the contract to be governed by the law of a jurisdiction other than this State or to require a resident individual or business to submit to the jurisdiction of another location for the resolution of disputes regarding the contract.
