Emergency preamble. Whereas, Acts of the Legislature do not become
effective until 90 days after adjournment unless enacted as
emergencies; and

 
Whereas, Acts of this and previous Legislatures have resulted in
certain technical errors and inconsistencies in the laws of
Maine; and

 
Whereas, these errors and inconsistencies create uncertainties
and confusion in interpreting legislative intent; and

 
Whereas, it is vitally necessary that these uncertainties and
this confusion be resolved in order to prevent any injustice or
hardship to the citizens of Maine; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore,

 
Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 4 MRSA §1231, sub-§4, as enacted by PL 1983, c. 863, Pt. B,
§§13 and 45, is amended to read:

 
4. Oath. Each trustee shall, within 10 days after the
effective date of this Act and December 1, 1984 or, thereafter,
within 10 days after his that trustee's appointment or election,
take an oath of office to faithfully discharge the duties of a
trustee, in the form prescribed by the Constitution of Maine.
Such The oath shall must be subscribed to by the trustee making
it, certified by the officer before whom it is taken and
immediately filed in the office of the Secretary of State.

 
Sec. 2. 4 MRSA §1606, sub-§2, as amended by PL 1997, c. 752, §1 and c.
788, §2, is repealed and the following enacted in its place:

 
2.__Limitation on securities issued.__The authority may not
issue securities in excess of $83,000,000 outstanding at any one
time, of which no less than $30,000,000 must be specifically
allocated to projects relating to the Judicial Branch, except for
the issuance of revenue refunding securities authorized by
section 1610 and securities issued under section 1610-A.__The
amount of securities that may be outstanding in the name of the
authority may be increased by the Legislature upon a showing by
the authority that its available revenues are sufficient to
support additional issuance of securities and that the issuance
