| | | Sec. 1. 22 MRSA §821, as enacted by PL 1989, c. 487, §11, is | | amended by adding at the end a new paragraph to read: |

| | | A person who performs an HIV test and concludes that the test | | is positive for human immunodeficiency virus or Acquired Immune | | Deficiency Syndrome shall report the results of the test, | | including the name of the person who is the subject of the test, | | to the department.__The department shall adopt rules to implement | | this paragraph.__Rules adopted pursuant to this paragraph are | | routine technical rules as defined in Title 5, chapter 375, | | subchapter II-A. |

| | | This bill requires positive HIV test results to be reported to | | the Department of Human Services and directs the department to | | adopt rules to implement the requirement. |
