F.__"Yard" means a system of parallel tracks, crossovers and
switches where railroad cars are switched and made up into
trains and where railroad cars, locomotives and other rolling
stock are kept when not in use or when awaiting repairs.

 
3.__Railroad property; trespassing.__A person is guilty of
trespassing if that person, without the railroad carrier's
consent, except to cross the property at a public highway or
other authorized crossing, knowingly enters on the railroad
property by:

 
A.__Standing, sitting, resting, walking, jogging, driving or
operating a recreational or nonrecreational vehicle,
including, but not limited to, a bicycle, motorcycle,
snowmobile, car or truck; or

 
B.__Engaging in recreational activity, including, but not
limited to, bicycling, hiking, fishing, camping, cross-
country skiing or hunting.

 
A person violating this subsection is subject to either a fine of
not more than $100 or imprisonment for not more than 30 days or
both.

 
4.__Stowaway; prohibited.__A person is guilty of being a
stowaway if that person, without the railroad carrier's consent,
rides on the outside of a train or inside a passenger car,
locomotive or freight car, including a box car, flatbed or
container.__A person violating this subsection is subject to
either a fine of not more than $1,000 or imprisonment of not more
than 6 months or both.

 
5.__Exemption.__Subsections 3 and 4 do not apply to the
following persons:

 
A.__A passenger on a train or an employee of a railroad
carrier engaged in the performance of official duties;

 
B.__A police officer, a firefighter, or an emergency
response person engaged in the performance of official
duties;

 
C.__A person going upon railroad property to rescue a person
or an animal or to remove an object that the person
reasonably believes to pose an imminent threat;
