Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 5 MRSA §1665, sub-§2-A is enacted to read:

 
2-A.__Inclusion in estimate; additional duty of Department of
Corrections.__In preparing budget estimates pursuant to this
section, the Department of Corrections shall include in its
proposed current services budget estimates:

 
A.__The amount necessary to fully fund the County Jail
Prisoner Support and Community Corrections Fund, established
in Title 34-A, section 1210-A, subsection 2, at current
levels, based on the United States Consumer Price Index
established by the United States Department of Labor, Bureau
of Labor Statistics; or

 
B.__A statement identifying the specific appropriations that
will be eliminated or reduced in the event that funds are
not budgeted to satisfy the Department of Corrections'
responsibility for fully funding the County Jail Prisoner
Support and Community Corrections Fund at current levels.__
The statement must indicate which counties and which
purposes of the fund will be affected.

 
The analysis and statement required by this subsection must be
included in the state budget document pursuant to section 1664.

 
Sec. 2. Legislative intent. It is the intent of the Legislature that
full funding for the County Jail Prisoner Support and Community
Corrections Fund, established in the Maine Revised Statutes,
Title 34-A, section 1210-A, subsection 2, adjusted by a factor
equal to the percent change in the United States Department of
Labor, Bureau of Labor Statistics' Consumer Price Index, be
included in the Governor's current services recommendations. If
the Governor submits legislation setting forth appropriations and
allocations for the County Jail Prisoner Support and Community
Corrections Fund that differs from the full budget request
submitted by the Department of Corrections, the Governor shall
simultaneously submit a report to the joint standing committee of
the Legislature having jurisdiction over corrections and criminal
justice matters and the joint standing committee of the
Legislature having jurisdiction over appropriations and financial
affairs explaining why the Governor's legislation differs from
the Department of Corrections' budget submission.
