Sec. 1. 32 MRSA §2355-A is enacted to read:

§2355-A.__Exceptions

Notwithstanding section 2355, the license of an oil burner technician may not be suspended or revoked for installing or servicing oil burning equipment in a chimney that is in need of repair or replacement as long as the oil burner technician notifies the owner of the chimney and the Office of the State Fire Marshal of the unsafe condition of the chimney before making the repair or installation.

SUMMARY

This bill exempts oil burner technicians from disciplinary actions involving the installation or servicing of oil burning equipment in an unsafe chimney. It does not, however, require that the oil burner technician notify the property owner and the Office of the State Fire Marshal concerning the condition of the chimney before making the repair or installation.
