Sec. 1. 5 MRSA §54 is enacted to read:

§54. Prohibition against competing with private industry

A state agency, board, commission, department or institution may not provide any service for a fee or undertake any enterprise that produces revenue that is in competition with private industry, except those services and enterprises that are determined by the Legislature to be necessary for the safety, health and welfare of the public.

SUMMARY

This bill prohibits the State from providing services for fees or undertaking enterprises that compete with private industry.
