Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 26 MRSA §603 is enacted to read:

 
§603.__Limits on mandatory overtime

 
1.__Definitions.__As used in this section, unless the context
otherwise indicates, the following terms have the following
meanings.

 
A.__"Employee" does not include a person who is a seasonal
employee.

 
B.__"Overtime" means the hours worked in excess of 8 hours
in a day or the hours worked in excess of 40 hours in a
calendar week.

 
2.__Limits on overtime.__An employer may not require an
employee to work overtime in violation of the following
limitations:

 
A.__An employer may not require an employee to work more
than 40 overtime hours in any period of 2 calendar weeks;
and

 
B.__An employer may not retaliate against an employee who
does not consent to work more than 40 overtime hours in any
period of 2 calendar weeks.

 
SUMMARY

 
This bill prohibits an employer from requiring an employee,
except a seasonal employee, to work more than 40 overtime hours
in any period of 2 calendar weeks and prevents the employer from
retaliating against an employee who does not consent to work
those hours.
