Sec. 1. 23 MRSA §1980, sub-§2-A, ķA, as enacted by PL 1993, c. 698, §2, is amended to read:

A. If an operator of a vehicle fails to pay a toll, the registered owner of that vehicle is liable for payment of the toll. If the registered owner fails to pay the toll, the registered owner is subject to a civil penalty as follows:

(1) Fifty dollars, except as provided in subparagraph (2) or (3);

(2) One hundred dollars, if a failure to pay occurs within 18 months of a prior failure to pay; or

(3) One hundred fifty dollars, if a failure to pay occurs within 18 months of 2 or more prior failures to pay.

A court shall transfer to the authority the proceeds received by the court from a penalty for a violation of this paragraph.__The authority may transfer up to 20% of these proceeds back to the court.

SUMMARY

This bill requires a court to transfer to the Maine Turnpike Authority the proceeds received by the court from a penalty for failure to pay a toll. The Maine Turnpike Authority may transfer up to 20% of these proceeds back to the court.
