Sec. 1. 8 MRSA §411, sub-§3, ¶¶E and F, as enacted by PL 1983, c. 732, §1, are amended to read:

E. Volumes of expected sales; and

F. The possession of a valid party state license.;

Sec. 2. 8 MRSA §411, sub-§3, ¶¶G and H are enacted to read:

G.__The potential for increased sales during a particular season of the year; and

H.__The potential market for sales in the general area of the place of business, including across state borders.

Sec. 3. 8 MRSA §411, sub-§4 is enacted to read:

4.__Denial of license.__ The commission shall provide to any person denied a license a detailed report explaining the reasons for the denial, including documentation that all considerations listed in subsection 3 were thoroughly evaluated.

SUMMARY

This bill amends the factors considered by the Tri-state Lotto Commission when issuing a license to include seasonal and cross- border potential sales. It requires that the commission provide a detailed report to an applicant who is denied a license, including proof that all considerations were properly evaluated and specifying the reason for the denial.
