| Sec. 1. Rulemaking. Resolved: That by November 1, 1999 the |
| Department of Mental Health, Mental Retardation and Substance |
| Abuse Services shall adopt rules regarding contracting for mental |
| health services. The rules must provide that the competitive bid |
| process is required for contractors with the department only if |
| the contractor that holds the contract is determined by the |
| commissioner to have performed in a fiscally irresponsible or |
| negligent manner or has lost the required license. Rules adopted |
| pursuant to this resolve are routine technical rules as defined |
| by the Maine Revised Statutes, Title 5, chapter 375, subchapter |
