Sec. 1. 30-A MRSA §3012 is enacted to read:

§3012.__Prohibition against licensing

1. Prohibition.__Municipalities may not license or regulate commercial businesses or professional occupations beyond that which is required or authorized by state law or beyond that which is necessary to protect public safety and public health.

2. Exemptions to application.__The provisions of this section do not apply to municipal regulations of taxicabs and massage parlors.

3. Public health and safety.__This section does not prevent a municipality from adopting ordinances or establishing regulations that protect the health and safety of the public.

SUMMARY

This bill prohibits municipalities from regulating commercial businesses and occupations beyond that which is required by the State except for purposes of public safety and public health.
