Sec. 1. 20-A MRSA §254, sub-§5, as enacted by PL 1983, c. 693, §§5 and 8, is repealed and the following enacted in its place:

5.__Medication.__The commissioner shall provide for the administration of medication within schools as follows.

A.__The commissioner may adopt or amend rules for the administration of medication in public or approved private schools.__Medication may not be administered by unlicensed personnel at these schools, except as provided by the written prescription of a physician or dentist or by the written permission of a parent or guardian of the individual receiving the medication.

B.__School personnel who are not licensed must be trained to administer medication.__Personnel administering medication must receive relevant information regarding the policies and procedures under which they are expected to administer medication.

SUMMARY

This bill requires unlicensed school personnel to be trained before administering medication to students in Maine's public schools and approved private schools.
