Item 1

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 12 MRSA §7405, sub-§14, as enacted by PL 1979, c. 420, §1, is
amended to read:

14. Shooting domestic animals. A person is guilty of
shooting domestic animals if, while on a hunting trip or in the
pursuit of wild animals or wild birds, he that person
intentionally, knowingly, recklessly or negligently shoots and
wounds or kills any domestic animal belonging to another person,
including a dog, cat or domestic bird.

SUMMARY

This bill amends the fish and wildlife law pertaining to
shooting domestic animals. The bill drops the condition that the
shooting must have occurred while on a hunting trip or while in
pursuit of wild animals or wild birds and clarifies that the
prohibition against shooting domestic animals applies only if the
domestic animal that is shot belongs to another person.
