Item 1

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 39-A MRSA §205, sub-§8, as enacted by PL 1991, c. 885, Pt. A,
§8 and affected by §§9 to 11, is amended to read:

8. Information. If the employer is making compensation
payments under this section, the employer shall file with the
board a statement of the employee's average weekly wages, as
defined in section 2 102, subsection 4, within 30 15 days after
the initial payment employer has notice or knowledge of the
injury or death, together with a wage statement or wage
statements in the case of multiple employment. A copy of this
information must be mailed to the person receiving payments. When
the only compensation claimed or payable is for medical services,
wage statements need not be submitted.

SUMMARY

Under current law, employers must file with the Workers'
Compensation Board a wage statement for an employee for whom the
employer is making compensation payments. This filing is due
within 30 days after the initial payment. The bill amends this
filing due date so that an employer would need to file the wage
statement within 15 days after having notice or knowledge of the
employee's injury or death for which compensation is being paid.
This bill also corrects a reference to a definition.
