Sec. 1. 12 MRSA §7053, sub-§6 is enacted to read:

6.__Approve beaver dam removal.__In addition to other powers granted in chapters 701 to 721, a warden may approve the removal of a beaver dam if, in the opinion of the warden, the presence of the dam has caused or may cause damage to an existing private road, woods or other private property.

Sec. 2. 38 MRSA, §480-Q, sub-§21 is enacted to read:

21. Removal of beaver dam. Removal of a beaver dam approved by a game warden under Title 12, section 7053, subsection 6.

SUMMARY

This bill allows a game warden to authorize the removal of a beaver dam without needing a permit under the natural resources protection laws if the beaver dam, in the opinion of the warden, has caused or may cause damage to private property, including woods or existing private roads.
