(3)__Neither original records nor identifying data are | removed from the facility or office that prepared the | records. |

| The commissioner and the person doing the research shall | preserve the anonymity of the person receiving services from | the department and may not disseminate data that refer to | that person by name, number or in any other way that might | lead to the person's identification; and |

| F.__To persons who directly supervise or report on the | health, behavior or progress of a juvenile, to the | superintendent of a juvenile's school and the | superintendent's designees and to agencies that are or might | become responsible for the health or welfare of a juvenile, | if the information is relevant to and disseminated for the | purpose of creating or maintaining an individualized plan | for the juvenile's rehabilitation. |

| | 2.__Civil violation.__A person who discloses information in | violation of this section commits a civil violation for which a | forfeiture not to exceed $1,000 may be adjudged. |

| | 3.__Disclosure of confidential information.__The disclosure of | confidential information as provided by this section is governed | by Title 5, section 9057, subsection 6. |

| §8905.__Disciplinary action |

| | The commissioner shall adopt rules describing disciplinary | offenses and punishments in juvenile correctional facilities and | establishing a fair and orderly procedure for processing | disciplinary complaints.__The rules must conform to this section.__ | Rules adopted pursuant to this subsection are routine technical | rules as defined by Title 5, chapter 375, subchapter II-A. |

| | 1.__Fairness and equity. The rules must ensure the maintenance | of a high standard of fairness and equity. |
|
| | 2.__Corporal punishment. Corporal punishment may not be | imposed. |
|
| | 3.__Punishment.__Punishment at the Maine Youth Center may | consist of warnings, restitution, labor at any lawful work and | loss of privileges. |
|
| | 4.__Restitution.__The imposition of restitution at all | juvenile facilities is subject to this subsection. |
|
|
