D.__"Day shift" means the period from 7 a.m. to 3 p.m. |

| E.__"Evening shift" means the period from 3 p.m. to 11 p.m. |
|
| F.__"Night shift" means the period from 11 p.m to 7 a.m. |
|
| | 2.__Minimum staffing standards.__The following are the minimum | staffing standards required for care to nursing home residents. |
|
| A.__Every nursing facility shall maintain a ratio of direct- | care providers to residents of no less than: |
|
| (1)__On the day shift, one direct-care provider for | every 5 residents; |
|
| (2)__On the evening shift, one direct-care provider for | every 8 residents; |
|
| (3)__On the night shift, one direct-care provider for | every 12 residents; |
|
| B.__In addition to the requirement in paragraph A, every | nursing facility shall maintain a ratio of licensed staff to | residents of no less than: |
|
| (1)__On the day shift, one licensed nurse for every 15 | residents; |
|
| (2)__On the evening shift, one licensed nurse for every | 20 residents; and |
|
| (3)__On the night shift, one licensed nurse for every | 30 residents. |
|
| C.__In addition to the requirements in paragraphs A and B | every nursing facility shall at mealtimes maintain a ratio | of one direct-care provider to every 3 residents.__This | ratio may be reached by staggering mealtimes for residents | as long as residents are not required to wait more than 5 | hours between meals. |

| | 3.__Public right to staffing information.__A nursing facility | shall prominently post for each shift information on the actual | number of licensed and unlicensed direct-care providers then on | duty as well as the ratio of direct-care providers to residents, | including information on the ratio of licensed staff to | residents.__This information must be displayed on a standardized | form supplied by the department.__In addition, this |
