Sec. 1. 24-A MRSA §2907-A is enacted to read:

§2907-A.__Compensation for damaged motor vehicles

All contracts of motor vehicle casualty insurance delivered or issued for delivery in this State covering motor vehicles registered in this State must provide coverage to return an insured vehicle that had a current inspection and was operational at the time of the loss or damage to its operating condition. In instances when an insured motor vehicle is destroyed, contracts must provide coverage to replace that insured motor vehicle with a motor vehicle in similar condition to the insured motor vehicle prior to its destruction.

SUMMARY

This bill requires that motor vehicle insurance policies provide coverage to return insured vehicles damaged in an accident to operating condition or, if an insured vehicle is destroyed in an accident, provide coverage to replace the destroyed vehicle with a vehicle in similar condition to the destroyed vehicle prior to its destruction.
