Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 38 MRSA c. 13-D is enacted to read:

 
CHAPTER 13-D

 
MERCURY EMISSIONS CONTROL

 
§1391.__Definitions

 
As used in this chapter, unless the context otherwise
indicates, the following terms have the following meanings.

 
1.__Mercury-added product.__"Mercury-added product" means a
product into which elemental mercury or mercury compounds are
intentionally added during its formulation or manufacture and in
which the continued presence of mercury is desired to provide a
specific characteristic or to perform a specific function.

 
§1392.__Disclosure of mercury content

 
After July 1, 1999, a manufacturer or wholesaler may not
supply a mercury-added product for sale in this State without
first notifying the commissioner in writing of the amount of
mercury in the product and the purpose that the mercury serves.

 
§1393.__Labeling

 
After July 1, 2000, a manufacturer or wholesaler may not sell
and a retailer may not knowingly sell a mercury-added product
unless the product is labeled to clearly inform a purchaser or
consumer that mercury has been added to the product.__The
department may adopt rules regarding labeling placement and
content.__The rules must give preference to placement of the
label on the product and product packaging.__Rules adopted
pursuant to this section are routine technical rules pursuant to
Title 5, chapter 375, subchapter II-A.

 
§1394.__Mercury-containing lamps; large use applications

 
1.__Lamps.__A person who sells fluorescent or other lamps that
contain mercury to the owner or manager of an industrial,
commercial, office or multi-unit residential building, or to any
person who replaces or removes from service outdoor lamps that
contain mercury, shall clearly inform the purchaser in writing on
the invoice for the lamps or in a separate writing that the lamps
contain mercury, a hazardous substance that is regulated by
federal or state law, and that they may not be placed in solid
waste.
