appeal under this section may not purchase a number of trap tags
greater than:

 
A.__The number of trap tags purchased by the person for the
most recent year in which the person held a lobster and crab
fishing license if the person held a lobster and crab
fishing license in 1996, 1997 or 1998.__In no case may a
person purchase a number of trap tags greater than the trap
limit established by rule for a lobster management zone in
which that person fishes; or

 
B.__The average number of trap tags purchased by license
holders in the lobster management zone in which the person
predominantly harvests lobsters if the person did not hold a
lobster and crab fishing license in 1996, 1997 or 1998.

 
SUMMARY

 
This bill implements one of the recommendations of the Lobster
Advisory Council regarding limited entry into the lobster
fishery. It establishes a Lobster License Appeals Board composed
of 3 members appointed by the Commissioner of Marine Resources to
review appeals from individuals who are denied a lobster and crab
fishing license because they do not meet the eligibility
requirements for a license. The board shall make recommendations
to the commissioner regarding the approval or denial of an
appeal, and the commissioner shall make the final decision on an
appeal.
