of the United States and residents of this State.__One member
must be a registered nurse with not less than 5 years of active
practice in nursing homes in the State.__Two members must be
representatives of the public.__Three members must be
administrators of nursing homes with not less than 5 years of
active experience in the State.__One member must be an
administrator of an intermediate care facility for the mentally
retarded with not less than 5 years of active practice in that
capacity.

 
Sec. 44. 32 MRSA §1901, sub-§1-A, as repealed by PL 1999, c. 84, §5
and amended by c. 179, §1, is repealed.

 
Sec. 45. 32 MRSA §1901, sub-§1-B, as repealed by PL 1999, c. 84, §5
and enacted by c. 179, §2, is repealed.

 
Sec. 46. 32 MRSA §1901, sub-§2, as repealed by PL 1999, c. 84, §5 and
amended by c. 179, §3, is repealed.

 
Sec. 47. 32 MRSA §13777, as amended by PL 1989, c. 720, §2, is
further amended to read:

 
§13777. Exceptions

 
This Act does not apply to any medical assistance or public
health programs administered by the Department of Human Services,
including, but not limited to, the Medicaid program and the Low
Cost Drug Program; to any employee benefit plan that is subject
to the Employee Retirement Income Security Act of 1974, 29 United
States Code, Section 1001, et seq.; and to any 3rd-party
prescription programs administered in accordance with and subject
to the limitations of the former Nonprofit Service Organizations
Preferred Provider Arrangement Act of 1985, Title 24, chapter 19,
subchapter II, or the Preferred Provider Arrangement Act of 1986,
Title 24-A, chapter 32.

 
Sec. 48. 33 MRSA §1669, sub-§6, as enacted by PL 1987, c. 734, §2, is
amended to read:

 
6. Removal of custodian. A transferor, the legal
representative of a transferor, an adult member of the minor's
family, a guardian of the person of the minor, the conservator of
the minor or the minor, if the minor as has attained 14 years of
age, may petition the court to remove the custodian for cause and
to designate a successor custodian, other than a transferor under
section 1655, or to require the custodian to give appropriate
bond.
