| | Emergency preamble. Whereas, Acts of the Legislature do not become | effective until 90 days after adjournment unless enacted as | emergencies; and |
|
| | Whereas, the Lake Arrowhead Community, Incorporated, is located | in the Town of Limerick and the Town of Waterboro; and |
|
| | Whereas, the Lake Arrowhead Community, Incorporated, has charged | the Town of Limerick and the Town of Waterboro membership fees | and assessments for property acquired by the 2 municipalities for | reasons of tax delinquency; and |
|
| | Whereas, the Town of Limerick and the Town of Waterboro have | resisted these fees and assessments, and the matter has resulted | in expensive and divisive litigation; and |
|
| | Whereas, in the judgment of the Legislature, these facts create | an emergency within the meaning of the Constitution of Maine and | require the following legislation as immediately necessary for | the preservation of the public peace, health and safety; now, | therefore, |
|
| Be it enacted by the People of the State of Maine as follows: |
|
| | Sec. 1. P&SL 1995, c. 37, §13-A is enacted to read: |
|
| | *Sec. 13-A.__Prohibited fees and assessments.__Notwithstanding any other | provision of this Act or the Maine Revised Statutes, Title 33, | chapter 31, the corporation may not charge a fee or assessment | for a property owned by a municipality, regardless of when a fee | or assessment may have been incurred. |

| | Sec. 2. Application. This Act applies to all fees and assessments | levied by the corporation on or after January 1, 1995. |
|
| | Emergency clause. In view of the emergency cited in the preamble, | this Act takes effect when approved. |
|
| | This bill amends the charter of the Lake Arrowhead Community, | Incorporated, by forbidding the community from charging the Town | of Limerick and the Town of Waterboro membership fees and | assessments for property owned by the municipalities. |
|
|
