An Act to Restrict the Use of Handheld Telephones while Driving

Be it enacted by the People of the State of Maine as follows:
Sec. 1. 29-A MRSA §2115
is enacted to read:
§2115.__Use of handheld telephone while operating motor vehicle
It is unlawful for a person operating a motor vehicle to use a
telephone that requires the operator to hold the telephone in the
operator's hand.
Violation of this section is a traffic infraction subject to a
forfeiture of not less than $50 for the first violation and $250
for the 2nd violation and each subsequent violation committed
within one year.
SUMMARY
This bill prohibits a person from using a handheld telephone
while operating a motor vehicle if the operator holds the
telephone in the operator's hand while driving. The bill makes
the offense a traffic infraction.
