Sec. 1. 17 MRSA §314-A, sub-§§9 and 10 are enacted to read:

9.__Governmental capacity.__For the purposes of Title 30, section 6208, a federally recognized Indian tribe operating high- stakes beano or high-stakes bingo under this section is operating in its governmental capacity.

10.__Exception.__Notwithstanding subsection 3, an organization licensed under this section may operate high-stakes beano or high-stakes bingo games on New Year's Eve and New Year's Day.

SUMMARY

This bill provides that a federally recognized Indian tribe that operates high-stakes beano or high-stakes bingo is operating in the tribe's governmental capacity. When operating in a governmental capacity, the tribe is not subject to taxation. The bill also allows high-stakes beano and high-stakes bingo games to be operated on New Year's Eve and New Year's Day.
