Emergency preamble. Whereas, Acts and resolves of the Legislature do
not become effective until 90 days after adjournment unless
enacted as emergencies; and

 
Whereas, the Saco Bay Planning Committee has completed a plan to
improve the beaches of Saco Bay with endorsements from the
municipalities of Saco, Old Orchard Beach and Scarborough; and

 
Whereas, the City of Saco requires the modification of an
existing federal coastal engineering structure for reducing
coastal erosion that has destroyed over 30 structures, public
roads and utilities and continues to threaten property and public
safety; and

 
Whereas, the modification of the coastal engineering structure
located in Camp Ellis, Saco, Maine will allow improved sand
management for all of Saco Bay; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore, be it

 
Sec. 1. Engineering analysis contract. Resolved: That the Department of
Conservation shall procure a contract with a qualified coastal
engineering firm to provide a detailed engineering analysis of
the recommendations for coastal engineering structure
modifications provided by the Saco Bay Regional Beach Management
Plan. The structure subject to the modifications is located on
the north side of the mouth of the Saco River in Camp Ellis,
Saco, Maine. The recommendations include, but are not limited
to, the following items.

 
1. The landward end of the coastal engineering structure must
be modified by adding rock material to the existing structure for
the purposes of roughening the existing profile to reduce wave
activity and related erosion.

 
2. The seaward end of the coastal engineering structure must
be modified by removing 1,000 feet of the seaward end of the
structure for purposes of allowing the natural flow of sand from
the Saco River to migrate onto the beaches in Saco Bay.

 
3. The existing sand dune in Camp Ellis must be reconstructed
by adding sand and vegetation sufficient to act as a buffer
against erosive wave activity, as well as to create public beach
and wildlife habitat; and be it further
