| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 22 MRSA §2660-A, sub-§2, ¶¶B and C, as enacted by PL 1987, c. | | 745, §1 and c. 816, Pt. KK, §20, are amended to read: |

| | | B. Water transported for use in well drilling, construction | | activities, concrete mixing, swimming pool filling, | | servicing portable toilets, firefighting, hospital | | operations, aquaculture, agricultural applications or civil | | emergencies; and |
|
| | | C. Water distilled as a by-product of a manufacturing | process; and. |
|
| | | Sec. 2. 22 MRSA §2660-A, sub-§2, ¶D, as repealed and replaced by PL | | 1989, c. 502, Pt. B, §22, is repealed. |

| | | The purpose of this bill is to strengthen safeguards for the | | health, safety and welfare of persons living in the vicinity of | | naturally occurring water resources who rely on that water source | | and to ensure that any water intended for drinking use is not | | transported in a manner that threatens the health, safety or | | welfare of any person. This bill removes the exception from the | | prohibition on transportation of water that applies solely to | | water that was used to supply water for bottling and sale. |
