| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 26 MRSA §663, sub-§§14 and 15 are enacted to read: |
|
| | 14.__Automobile body shop technician.__"Automobile body shop | technician" means a person who is primarily engaged in the | restoration, body and frame repair and servicing of automobiles | and trucks as an employee of an establishment primarily engaged | in the business of selling automobiles or trucks to the ultimate | purchaser, except when the employee is paid by the employer on an | hourly basis. |

| | 15.__Automobile service writer.__"Automobile service writer" | means a person who is primarily engaged in receiving and | organizing customer requests for repair, restoration or servicing | of automobiles or trucks as an employee of an establishment | primarily engaged in the business of selling automobiles or | trucks to the ultimate purchaser, except when the employee is | paid by the employer on an hourly basis. |

| | Sec. 2. 26 MRSA §664, sub-§3, ķA, as enacted by PL 1995, c. 305, §1, | is amended to read: |
|
| A. Automobile body shop technicians, automobile mechanics, | automobile parts clerks and, automobile salesmen and | automobile service writers as defined in section 663; |
|
| | This bill streamlines the paperwork necessary in the | computation of wages for automobile body shop technicians and | automobile service writers who are paid on an incentive basis | rather than an hourly rate. This bill exempts those employees | from overtime compensation. |
