Sec. 1. 26 MRSA §774-A is enacted to read:

§774-A.__Exemption from limits on employment of minors

The Department of Labor shall adopt rules establishing a process for exempting minors or their employers from one or more of the limitations on employment set forth in sections 771 to 774.__The rules must set forth the conditions under which the department will approve an exemption and must require that the employer and the minor's parent, guardian or custodian consent to the exemption.__Rules adopted under this section are routine technical rules as defined in Title 5, chapter 375, subchapter II-A.

SUMMARY

This bill directs the Department of Labor to adopt rules setting forth a process under which minors may be exempted from laws limiting the type of work they may perform and the hours and conditions under which they may work. The exemption is only effective if the potential employer and the minor's parent, guardian or custodian give permission to the exemption.
