Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. PL 1997, c. 24, Pt. A, §4, first ¶ is amended to read:

 
Sec. A-4. Workers' compensation positions. Limited period positions may
be established for former regular employees of the State who are
presently receiving workers' compensation payments from the State
when that action will enable those employees to return to
productive employment with the State. These positions may be
established, providing funds are available, only until those
employees can be returned to regular positions. A person placed
in a limited period position created pursuant to this section is
considered to be a member of the same bargaining unit of which
that person was a member prior to the injury that resulted in
payments under the workers' compensation law.

 
Sec. 2. Retroactivity. This Act applies retroactively to June 26,
1997.

 
SUMMARY

 
This bill clarifies the bargaining unit status of a state
employee who is placed in a limited period position to enable the
person to return to employment following a work-related injury.
The bill provides that the person is a member of the same
bargaining unit of which the person was a member prior to the
injury.
