| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 17-A MRSA §213 is enacted to read: |

| | | §213.__Assault with dangerous dog |
|
| | | 1.__A person is guilty of assault with a dangerous dog if the | | person intentionally, knowingly or recklessly causes bodily | | injury or offensive physical contact to another person with a | | dog. |
|
| | | 2.__For a person convicted under this section, a court must | | make an inquiry under chapter 54 as part of the sentencing and | | order restitution for any financial damage to the defendant. |
|
| | | 3.__Assault with a dangerous dog is a Class D offense. |
|
| | | This bill creates the criminal offense of assault with a | | dangerous dog and requires the court to impose restitution during | | the sentencing of a person convicted of the offense if the victim | | suffered any financial damage. |
