| | | Sec. 1. 22 MRSA §306-A, sub-§5-A, as enacted by PL 1997, c. 689, Pt. | | B, §18 and affected by Pt. C, §2, is amended to read: |

| | | 5-A. Public hearing. Within 30 days of the filing of an | | application, the department shall advertise and conduct in a | | location convenient to the proposal location a public | informational meeting | | present information about the proposal. Members of the public | | must be allowed to present testimony. |

| | | Current law requires the Department of Human Services to | | advertise and hold a public informational meeting at which an | | applicant for a certificate of need for the construction or | | modification of health care facilities is required to present | | information about the proposal. |
|
| | | This bill instead requires the department to advertise and | | hold a public hearing at which the applicant presents information | | about the proposal and the public is allowed to present | | testimony. |
