| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 17-A MRSA §363 is enacted to read: |

| | | 1.__A person is guilty of contract theft if the person enters | | into a written construction contract to perform work and receives | | the consideration to do the work then fails to perform the work | | within the time specified in the contract plus 60 days or, if | | there is no time specified in the contract, within 90 days. |

| | | 2.__For purposes of this section, "construction contract" has | | the same meaning as in Title 10, section 1111, subsection 2. |

| | | 3.__Contract theft is a Class D crime. |

| | | This bill creates the crime of contract theft when a person | | enters into a written construction contract and receives the | | money but then fails to do the work within a certain period of | | time. Contract theft is a Class D crime. |
