Whereas, the study must be initiated before the 90-day period expires in order that the study may be completed and a report submitted in time for submission to the next legislative session; and

Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it

Sec. 1. Commission established. Resolved: That the Blue Ribbon Commission on the East-West Rail Corridor, referred to in this resolve as the "commission," is established; and be it further

Sec. 2. Commission membership. Resolved: That the commission consists of the following 12 members:

1. Two members of the Senate, appointed by the President of the Senate;

2. Two members of the House of Representatives, appointed by the Speaker of the House, one of whom represents the party with the largest number of members in the House of Representatives and one of whom represents the party with the 2nd largest number of members in the House of Representatives;

3. The Commissioner of Transportation or the commissioner's designee;

4. The Commissioner of Labor or the commissioner's designee;

5. The Chief Executive Officer of the Finance Authority of Maine or the chief executive officer's designee;

6. The Director of the Office of Tourism and Community Development or the director's designee; and

7. Four members appointed jointly by the President of the Senate and the Speaker of the House, one to represent each of the following:

A. The aeronautics industry;

B. The railroad industry;
