| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 5 MRSA §90-B is enacted to read: |

| §90-B.__Inquiries from public |
|
| | If the Secretary of State receives an inquiry from a member of | the public concerning an issue under the jurisdiction of the | Secretary of State, the Secretary of State must send the member | of the public a reply directly responsive to the member of the | public's inquiry and not just a copy of an agency rule or form | letter. |

| | Sec. 2. 29-A MRSA §505, sub-§1, as enacted by PL 1993, c. 683, Pt. A, | §2 and affected by Pt. B, §5, is amended to read: |

| | 1. Definition. For purposes of this section, "farm truck" | means a truck equipped with axles other than dolly axles under | section 1902, subsection 4, or a farm truck towing a trailer or | semitrailer when that truck is used primarily for transportation | of agricultural commodities, supplies or equipment for or from a | farm owned, operated or occupied by the registrant. "Farm truck" | includes a truck used for the transportation of landscaping | commodities, supplies or equipment to or from a farm owned, | operated or occupied by the registrant as long as the truck is | not used on a substantially daily delivery schedule on | established routes. "Farm truck" does not include a truck used | for the retail delivery of milk or used on a substantially daily | delivery schedule on established routes. |

| | This bill allows farmers to use trucks registered as farm | trucks to haul landscaping commodities, supplies and equipment to | and from their farms. This bill also requires the Secretary of | State to reply responsively to inquiries from the public. |
