| | | Emergency preamble. Whereas, Acts of the Legislature do not become | | effective until 90 days after adjournment unless enacted as | | emergencies; and |

| | | Whereas, this legislation provides for the relocation of nesting | | areas for ospreys; and |
|
| | | Whereas, in order for the relocation to happen before the return | | of ospreys to nesting areas in April, this legislation needs to | | be enacted in a timely manner; and |
|
| | | Whereas, in the judgment of the Legislature, these facts create | | an emergency within the meaning of the Constitution of Maine and | | require the following legislation as immediately necessary for | | the preservation of the public peace, health and safety; now, | | therefore, |

| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 23 MRSA §4206, sub-§10 is enacted to read: |
|
| | | 10.__Osprey relocation.__The commissioner, with the advice of | | the Commissioner of Inland Fisheries and Wildlife, shall | | establish a relocation program providing for suitable nesting | | areas for ospreys when nests are threatened by maintenance or | | repair to any bridge within the state highway system. |

| | | Emergency clause. In view of the emergency cited in the preamble, | | this Act takes effect when approved. |
|
| | | This bill provides for the relocation of nesting areas for | | ospreys that are displaced by bridge repair or maintenance within | | the jurisdiction of the Department of Transportation. |
