| | Preamble. Whereas, Maine is committed to supporting disabled | persons of all ages to remain in their homes and communities to | the maximum extent feasible; and |

| | Whereas, there is a critical shortage of licensed nursing | personnel to assist consumers with medication administration and | other health-related tasks in the home; and |

| | Whereas, this shortage of licensed staff also extends to | licensed facility settings such as nursing homes and assisted | living facilities; and |
|
| | Whereas, the State Board of Nursing has the authority to | determine which tasks licensed nurses may delegate to unlicensed | persons; now, therefore, be it |
|
| | Sec. 1. Review of rules. Resolved: That the State Board of Nursing | shall undertake a timely review of its rules in order to identify | how those rules might be amended to allow broader delegation, | with reasonable requirements to ensure consumer safety; and be it | further |

| | Sec. 2. Report. Resolved: That the State Board of Nursing shall | report the results of its review, including the progress of any | proposed rulemaking, to the Joint Standing Committee on Health | and Human Services no later than February 1, 2002. |

| | This resolve directs the State Board of Nursing to review its | rules to identify how those rules might be amended to allow | broader delegation. |

| | This resolve also directs the State Board of Nursing to report | the results of its review, including the progress of any proposed | rulemaking, to the Joint Standing Committee on Health and Human | Services no later than February 1, 2002. |
