Sec. 1. 26 MRSA §563, sub-§6, as repealed and replaced by PL 1975, c. 519, §13, is amended to read:

6. Employee. "Employee" means any person, including a minor whether lawfully or unlawfully employed, who is employed or permitted to work by the State, a state agency, county, municipal corporation, school district or other public corporation or political subdivision. "Employee" in an employer's educational facility includes any person who is a student at that educational facility.

SUMMARY

This bill amends the definition of "employee" for purposes of the laws governing the occupational safety and health laws to allow the Department of Labor, Bureau of Labor Standards to consider the safety and health of students when conducting enforcement inspections in public sector educational facilities.
