Sec. 1. 14 MRSA §8104-A, sub-§5 is enacted to read:

5.__School administrative units.__A school administrative unit is liable for its negligent acts or omissions if the school administrative unit knew or had reason to know of and did not prevent the attempt or threat of physical force or physical force against a student, damage or destruction of property or trespass on property of a student, or harassment or terrorizing of a student while on school grounds or during a school supervised activity for reason of the race, color, religion, sex, ancestry, national origin, physical or mental disability or sexual orientation of the student.

SUMMARY

This bill allows a student who is harassed or assaulted on school grounds or during a school supervised activity for reasons of the race, color, religion, sex, ancestry, national origin, physical or mental disability or sexual orientation of the student to sue the school administrative unit for failing to prevent the abuse.
