C. The operator shall secure properly a child who is less
than 12 years of age or who weighs less than 100 pounds in
the rear seat of a vehicle, if possible, when that vehicle
is equipped with a front-seat, passenger-side air bag
supplemental restraint system.

 
SUMMARY

 
This bill requires a child who weighs less than 40 pounds to
be secured in a child safety seat; current law requires a child
under 4 years of age to be placed in a child safety seat. The
bill also requires a child who weighs at least 40 pounds but less
than 80 pounds and who is less than 8 years of age to be secured
in a child booster seat when riding in a motor vehicle. A child
who is less than 18 years of age is required to be secured by the
operator of the motor vehicle in a child safety seat, a child
booster seat or a seat belt, depending on the weight or age of
the child. A child under 12 years of age or who weighs less than
100 pounds is required to be secured in the back seat of a
vehicle, if it is possible to do so, if that vehicle is equipped
with a front-seat, passenger-side air bag.
