Sec. 1. Medicaid buy-in for persons with disabilities. Resolved: That by January
1, 2002, the Department of Human Services shall amend the rules
regarding eligibility for persons with disabilities to purchase
coverage under the Medicaid program. The amended rules must
maintain the income eligibility limit of 250% of the federal
nonfarm income official poverty level for earned and unearned
income combined and must remove any limitation on unearned
income. The amended rules must grant eligibility to employed
persons who have a medically improved disability. Rules adopted
pursuant to this section are routine technical rules as defined
by the Maine Revised Statutes, Title 5, chapter 375, subchapter
II-A.

 
SUMMARY

 
This resolve requires the Department of Human Services to
amend the rules allowing persons with disabilities to purchase
coverage in the Medicaid program. The rules must maintain income
eligibility limits while removing separate limits on earned and
unearned income and provide eligibility for employed persons who
have a medically improved disability.
