| | | Sec. B-1. 34-B MRSA §1219, sub-§3 is enacted to read: |

| | | 3. Court-based diversion program.__The department shall | | develop a program to facilitate the diversion of persons with | | mental illness away from incarceration.__The department shall | | designate at least one liaison to the District Courts within each | | of the prosecutorial districts established under Title 30-A, | | section 254 to work with district attorneys, defense attorneys, | | judges, bail commissioners and others to help develop and design | | plans for meeting the needs of persons with mental illness and | | diverting them away from incarceration. |

| | | By January 30th of each year, beginning in 2003, the department | | shall report to the joint standing committee of the Legislature | | having jurisdiction over criminal justice matters on the | | department's implementation of the diversion program developed | | pursuant to this subsection. |

| | | Sec. C-1. Mental illness training for judiciary, jail staff and others. The | | Department of Behavioral and Developmental Services shall | | establish a research-based training program designed to increase | | awareness of the needs of persons with mental illness within the | | criminal justice system. The training must be made available to | | trial judges, jail staff and others within the criminal justice | | system who do not currently receive such training. The | | department shall provide, no later than January 30, 2003, a | | report to the joint standing committee of the Legislature having | | jurisdiction over criminal justice matters on the development and | | implementation of the training program. |
