| | Sec. 1. Rulemaking. Resolved: That, by July 1, 2004, the | Department of Human Services shall adopt rules regarding home | day care providers and summer camps. Rules adopted pursuant | to this resolve are major substantive rules as defined in the | Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A. | The rules must include the following provisions. |

| | 1. For home day care providers the number of children who | may be cared for must equal the number of children the | provider is licensed to care for even if one child is an | infant. |

| | 2. For home day care providers the number of children who | may be cared for may exceed the number of children the | provider is licensed to care for by 4 during times of shift | changes and unexpected events, such as unscheduled school | closings, for a time period of up to 150 consecutive minutes | at any one time. |

| | 3. The rules for summer camps must be identical to the | rules for home day care providers. |

| | This resolve directs the Department of Human Services to | adopt rules regarding home day care providers and summer | camps. The rules are major substantive rules. The rules must | change the treatment of infants in the staffing ratios, allow | more flexibility in times of shift changes and other | unexpected events and make summer camp rules the same as home | day care rules. |
