Sec. 1. Rulemaking. Resolved: That, by July 1, 2004, the
Department of Human Services shall adopt rules regarding home
day care providers and summer camps. Rules adopted pursuant
to this resolve are major substantive rules as defined in the
Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.
The rules must include the following provisions.

 
1. For home day care providers the number of children who
may be cared for must equal the number of children the
provider is licensed to care for even if one child is an
infant.

 
2. For home day care providers the number of children who
may be cared for may exceed the number of children the
provider is licensed to care for by 4 during times of shift
changes and unexpected events, such as unscheduled school
closings, for a time period of up to 150 consecutive minutes
at any one time.

 
3. The rules for summer camps must be identical to the
rules for home day care providers.

 
SUMMARY

 
This resolve directs the Department of Human Services to
adopt rules regarding home day care providers and summer
camps. The rules are major substantive rules. The rules must
change the treatment of infants in the staffing ratios, allow
more flexibility in times of shift changes and other
unexpected events and make summer camp rules the same as home
day care rules.
