Sec. 1. 22 MRSA §2383, sub-§1, as amended by IB 1999, c. 1, §6, is further amended to read:

1. Marijuana. Except as provided in section 2383-B, subsection 5, possession of a usable amount of marijuana of a weight equal to or less than 1 1/4 ounces is a civil violation for which a forfeiture of not less than $200 nor more than $400 must be adjudged for the first offense. A forfeiture of $400 must be adjudged for the 2nd and subsequent offenses within a 6-year period.

SUMMARY

This bill clarifies that possession of a usable amount of marijuana of a weight equal to or less than 1 1/4 ounces is a civil violation. Possession of larger amounts is a Class E crime under the Maine Revised Statutes, Title 17-A, section 1107-A.
