| | Sec. 1. Rulemaking. Resolved: That by November 1, 2003, the | Department of Human Services shall amend the rules affecting | the MaineCare medical care reimbursement formula for hospital | services. Rules adopted pursuant to this section are routine | technical rules as defined in the Maine Revised Statutes, | Title 5, chapter 375, subchapter 2-A. The rules must: |

| | 1. Exclude from reimbursement the costs of advertising for | hospital services or for physicians who serve on the staff of | the hospital; |
|
| | 2. Exclude from reimbursement the costs of physician time | that is not spent in direct patient care or other required | hospital or patient-related activity; |
|
| | 3. Exclude all reimbursement if the hospital uses economic | credentialing to exclude physicians who are not employed by | the hospital; and |
|
| | 4. Restrict physician reimbursement to direct care services | provided to patients. |

| | This resolve directs the Department of Human Services to | amend the rules for reimbursement under the MaineCare program | for the reimbursement of hospitals by November 1, 2003. It | designates the rules as routine technical rules as defined in | Title 5, chapter 375, subchapter 2-A. |
