| Sec. 1. Rulemaking. Resolved: That by November 1, 2003 the |
| Department of Human Services shall adopt rules for |
| reimbursement for durable medical equipment under the |
| MaineCare program for the process for determining deductible |
| requirements for the medically needy. The rules must amend |
| the process to increase the protected income level to the |
| federal poverty level and must waive the deductible process |
| for persons who have been diagnosed to have a terminal |
| illness. Rules adopted pursuant to this section are routine |
| technical rules as defined in the Maine Revised Statutes, |
| Title 5, chapter 375, subchapter 2-A. |
