Sec. 1. 8 MRSA §374, sub-§5, as amended by PL 1997, c. 373, §7, is further amended to read:

5. Wildlife lottery game. No later than January 30, 1996, the commission, in consultation with the Maine Outdoor Heritage Fund Board, shall develop and initiate a wildlife lottery game designed to raise funds for the Maine Outdoor Heritage Fund established pursuant to Title 12, chapter 714. The commission shall provide the net proceeds of this wildlife lottery game to the Maine Outdoor Heritage Fund annually. The wildlife lottery game must include tickets in $1, $2, $3 and $5 denominations. The commission shall change the wildlife game ticket tickets periodically throughout the year. The commission shall adopt rules to establish a percentage of annual sales revenue from the wildlife lottery game to be used for marketing of wildlife lottery game tickets.__Rules pursuant to this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

Sec. 2. 8 MRSA §376-A is enacted to read:

§376-A.__Conditional requirement to offer wildlife lottery

game tickets

A lottery sales agent shall offer for sale tickets for the wildlife lottery game, pursuant to section 374, subsection 5,__ in accordance with the following requirements.

1.__No wildlife game tickets required.__If an agent offers for sale fewer than 3 types of tickets of a given dollar denomination, the agent is not required to offer any wildlife lottery game tickets of that denomination.

2.__One wildlife game ticket required.__If an agent offers for sale 3 to 6 types of tickets of a given dollar denomination, one of the types of tickets offered must be a wildlife lottery game ticket.

3.__Two wildlife game tickets required.__If an agent offers for sale 7 to 9 types of tickets of a given dollar denomination, 2 of the types of tickets offered must be wildlife lottery game tickets.

4.__Three wildlife lottery game tickets required. If an agent offers for sale 10 or more types of tickets of a given dollar denomination, 3 of the types of tickets offered must be wildlife lottery game tickets.
